Waiver, Release of Liability and Assumption of Risk

Please read carefully. This document affects your legal rights.

1. Who this agreement covers. In this agreement, "the Company" means Rachel Rowley, LLC, doing business as Alchemy Method Fitness, and Forge Fitness, together with their owners, officers, trainers, instructors, employees, contractors, agents, insurers, successors and assigns.

2. Activities covered. This agreement covers my participation in all programs and services offered by the Company, including small-group personal training, group classes, individual training, fitness assessments, InBody body composition scans, exercise programming, nutrition and recovery coaching, and my use of the studio, its equipment and its premises (together, "the Activities").

3. Age. I confirm that I am at least 18 years old.

4. Health and fitness to participate. I confirm that I am in good physical health and have no medical condition that would prevent me from participating safely. I understand that the Company recommends I consult a physician before beginning any exercise program, and that it is my responsibility to do so. I agree to tell my trainer, before training, about any injury, illness, medical condition, medication, pregnancy or recent childbirth that could affect my participation, and to tell my trainer promptly if anything changes. I agree to stop exercising and tell my trainer immediately if I feel pain, dizziness, shortness of breath or any other discomfort.

5. Nutrition and wellness guidance. I understand that the Company's trainers are not physicians or registered dietitians, and that any nutrition, sleep or recovery guidance is general wellness information, not medical advice, diagnosis or treatment. I am responsible for consulting a qualified medical professional about my own health needs.

6. Assumption of risk. I understand that strength training and other physical exercise involve inherent risks, including but not limited to muscle strains and sprains, joint and back injuries, injuries from equipment or weights, falls, cardiovascular events, permanent disability and death. I understand that these risks exist even when the Activities are supervised, instructed and programmed with reasonable care. I voluntarily choose to participate and I knowingly assume all of these risks, both known and unknown.

7. RELEASE OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, I, FOR MYSELF AND MY HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, RELEASE, WAIVE AND DISCHARGE THE COMPANY FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES AND CAUSES OF ACTION OF ANY KIND, KNOWN OR UNKNOWN, ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE COMPANY, ITS TRAINERS OR INSTRUCTORS, WHETHER IN INSTRUCTION, SUPERVISION, PROGRAMMING, ASSESSMENT, OR THE CONDITION OF THE PREMISES OR EQUIPMENT.

8. Indemnification. I agree to indemnify and hold the Company harmless from any claims, losses or expenses, including reasonable attorneys' fees, brought by any person or entity arising from my participation in the Activities or my breach of this agreement.

9. Studio rules and conduct. I agree to follow my trainer's instructions and all studio rules, to use equipment only as intended and as instructed, to train within my own limits, and to ask for help when I am unsure how to perform an exercise.

10. Emergency medical care. If I am injured or become ill, I authorize the Company to call emergency services and to obtain emergency medical care for me. I am responsible for any resulting medical costs.

11. Personal property. The Company is not responsible for personal property that is lost, stolen or damaged while on or about the premises.

12. Photos and video. I consent to the Company taking photos and video during classes and using them in its website, social media and marketing without payment to me. I may opt out at any time by telling my trainer or emailing the studio, and the Company will not use new images of me after that.

13. General. This agreement is governed by the laws of the State of Washington. If any part of this agreement is found invalid or unenforceable, the remaining parts will stay in full force and effect. This agreement applies to all of my current and future participation in the Activities.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, AND I SIGN IT VOLUNTARILY.

Please answer each question honestly before your first class. This helps your trainer keep you safe and adjust your program to you.

1. Has a doctor ever told you that you have a heart condition, or high blood pressure?

6. Do you have a bone, joint or soft-tissue problem (muscle, ligament or tendon) that could get worse with exercise? Include past injuries or surgeries that still bother you.

8. Has a doctor ever said you should only do medically supervised exercise, or limit your physical activity?

If you answered YES to any question: please talk with your doctor before starting, and let your trainer know before your first class. We may ask for your doctor's OK to exercise.
If you answered NO to every question: you're cleared to start. Begin at your own pace and tell your trainer if anything changes.

I confirm that I have read and answered these questions accurately and completely. I agree to tell my trainer right away if my health changes.
